Text or data mining; web scraping

You shall not conduct, facilitate, authorise or permit any text or data mining or web scraping in relation to our site or any services provided via, or in relation to, our site. This includes using (or permitting, authorising or attempting the use of):

  • Any “robot”, “bot”, “spider”, “scraper” or other automated device, program, tool, algorithm, code, process or methodology to access, obtain, copy, monitor or republish any portion of the site or any data, content, information or services accessed via the same.
  • Any automated analytical technique aimed at analysing text and data in digital form to generate information which includes but is not limited to patterns, trends and correlations.
 

This clause shall not apply insofar as (but only to the extent that) we are unable to exclude or limit text or data mining or web scraping activity by contract under the laws which are applicable to us.

Breaches of this Policy

If you fail to comply with the provisions of this Policy, we may take action as set out in this Part 7. A breach of this Policy also constitutes a material breach of the Terms of Use of our Website. We may take one or more of the following actions in response to your breach:

  • Suspend or terminate your right to use our Website;
  • Remove, either temporarily or permanently, your communication, User Content, or other submission from our Website;
  • Issue you with a written warning;
  • Take legal proceedings against you for reimbursement of any and all relevant costs on an indemnity basis resulting from your breach;
  • Take further legal action against you, as appropriate;
  • Disclose such information to law enforcement authorities as required or as we deem reasonably necessary; and/or
  • Any other actions which We deem reasonably appropriate (and lawful).
 

We hereby exclude any and all liability arising out of any actions that we may take in response to your breach.

Assignment

We can transfer our rights and obligations under these terms to any third party, provided this does not adversely affect your rights under these terms.

Law and Jurisdiction

This Policy, and the relationship between you and us (whether contractual or otherwise) shall be governed by, and construed in accordance with, the laws of the State of Florida. Any dispute, controversy, proceedings, or claim between you and Us relating to this Policy or to the relationship between you and Us (whether contractual or otherwise) shall be subject to the exclusive jurisdiction of the courts of the State of Florida.
